These laws and initiatives have laid the foundation for systemic support and empowerment, and efforts for promoting inclusion, dignity, non-discrimination, and mainstream integration for transgender persons, fostering a society where they can thrive with equal rights and opportunities.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #3366ff;\"><strong>Constitutional Provisions<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #3366ff;\"><strong>The Supreme Courtin its judgment in the case\u00a0<em>National Legal Services Authority (NALSA) v. The\u00a0National Council for Transgender Persons, advises on policies and monitors welfare schemes.\u00a0The\u00a0National Portal for Transgender Persons, launched on\u00a025 November 2020, enables online applications for identity certificates and access to benefits.\u00a0The\u00a0SMILE Scheme, introduced in\u00a0February 2022, provides livelihood, skill training, and shelter support through\u00a0<em>Garima Greh<\/em>\u00a0centres and\u00a0<em>Ayushman Bharat TG Plus<\/em>\u00a0health coverage.\u00a0These initiatives collectively promote inclusion, dignity, and equal opportunities for transgender citizens.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #3366ff;\"><strong>In addition to that, the\u00a0Department of Social Justice &amp; Empowerment has issued \u201cEqual Opportunities Policy for Transgender Persons\u201d\u00a0to ensure that the Transgender community has equal access to employment opportunities etc.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #3366ff;\"><strong>National Council for Transgender Persons<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #3366ff;\"><strong>The\u00a0Central Government constituted National Council for Transgender Persons on 21st August 2020\u00a0\u00a0and was reconstituted vide notification dated 16<sup>th<\/sup>\u00a0November, 2023. It serves as a\u00a0statutory body\u00a0under the Ministry of Social Justice and Empowerment\u00a0to safeguard and promote the rights of transgender persons\u00a0in India.\u00a0The council also has five representatives of transgender community, representatives of NHRC and NCW, representatives of State Governments and UTs and experts representing NGOs.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #3366ff;\"><strong><img decoding=\"async\" src=\"https:\/\/static.pib.gov.in\/WriteReadData\/userfiles\/image\/image006KOQX.png\" alt=\"\" \/><\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #3366ff;\"><strong>Functions &amp; Responsibilities<\/strong><\/span><\/p>\n<ol style=\"text-align: justify;\">\n<li><span style=\"color: #3366ff;\"><strong>Advisory Role: Advise the Central Government on formulation of policies, programmes, legislation and projects with respect to transgender persons.<\/strong><\/span><\/li>\n<li><span style=\"color: #3366ff;\"><strong>Monitoring &amp; Evaluation: Monitor and evaluate the impact of policies and programmes designed for achieving equality and full participation of transgender persons.<\/strong><\/span><\/li>\n<li><span style=\"color: #3366ff;\"><strong>Review &amp; Coordination: Review and coordinate the activities of all departments of government and non-governmental organisations dealing with transgender persons. This is to ensure coherence, effectiveness and avoid duplication or gaps.<\/strong><\/span><\/li>\n<li><span style=\"color: #3366ff;\"><strong>Grievance Redressal: Redress grievances of transgender persons.<\/strong><\/span><\/li>\n<li><span style=\"color: #3366ff;\"><strong>Other Prescribed Functions: Perform such other functions as may be prescribed by the Central Government.\u00a0<\/strong><\/span><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><span style=\"color: #3366ff;\"><strong>SMILE (Support for Marginalised Individuals for Livelihood and Enterprise) Scheme<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #3366ff;\"><strong>Launched by the\u00a0Ministry of Social Justice and Empowerment (MoSJ&amp;E), it is a flagship initiative\u00a0aimed at the comprehensive rehabilitation and empowerment of transgender persons and other marginalised communities in India. Introduced as a Central Sector Scheme,\u00a0SMILE\u00a0was launched on February 12, 2022 and operationalised to align with the Transgender Persons (Protection of Rights) Act, 2019.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #3366ff;\"><strong>SMILE aims to uphold the constitutional rights under Articles 14, 15, and 21, ensuring equality, non-discrimination, and the right to dignity for transgender persons. This scheme reflects the government\u2019s commitment to mainstreaming transgender individuals, by addressing their socio-economic challenges through targeted and inclusive interventions.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #3366ff;\"><strong>The SMILE Scheme is designed to provide\u00a0holistic support through\u00a0the\u00a0&#8220;Comprehensive Rehabilitation for Welfare of Transgender Persons.&#8221;<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #3366ff;\"><strong><img decoding=\"async\" src=\"https:\/\/static.pib.gov.in\/WriteReadData\/userfiles\/image\/image007IDVF.jpg\" alt=\"\" \/><\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #3366ff;\"><strong>Primary objectives of SMILE scheme:<\/strong><\/span><\/p>\n<ol style=\"text-align: justify;\">\n<li><span style=\"color: #3366ff;\"><strong>Skill Development and Employment: Offering vocational training and skill upgradation programs to enhance employability and mandates inclusive education and vocational opportunities.<\/strong><\/span><\/li>\n<li><span style=\"color: #3366ff;\"><strong>Scholarship Schemes:\u00a0The scholarships are aimed at reducing incidences of drop-out and aiding transition from the elementary to the secondary stage for transgender students through an automated online system using a single login credential.<\/strong><\/span><\/li>\n<li><span style=\"color: #3366ff;\"><strong>Composite Medical Health:\u00a0The government ensures access to healthcare for transgender persons through these measures below. These benefits are accessible at both private and government hospitals.<\/strong><\/span><\/li>\n<\/ol>\n<ol style=\"text-align: justify;\">\n<li><span style=\"color: #3366ff;\"><strong>Providing gender-affirming care, HIV surveillance, counseling, and integration with the Ayushman Bharat \u2013 Pradhan Mantri Jan Arogya Yojana (PM-JAY) for free medical coverage, upholding the right to health under Article 21 of the Constitution.<\/strong><\/span><\/li>\n<li><span style=\"color: #3366ff;\"><strong>Launching Ayushman Bharat TG Plus, a dedicated health insurance scheme for transgender persons.<\/strong><\/span><\/li>\n<li><span style=\"color: #3366ff;\"><strong>Offering free medical coverage of \u20b95 lakh per person per year.<\/strong><\/span><\/li>\n<li><span style=\"color: #3366ff;\"><strong>The insurance covers a comprehensive healthcare package, including:<\/strong><\/span>\n<ul>\n<li><span style=\"color: #3366ff;\"><strong>Gender-affirming procedures<\/strong><\/span><\/li>\n<li><span style=\"color: #3366ff;\"><strong>Hormone therapy<\/strong><\/span><\/li>\n<li><span style=\"color: #3366ff;\"><strong>Sex reassignment surgery (SRS) and post-operative care<\/strong><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<ol style=\"text-align: justify;\" start=\"4\">\n<li><span style=\"color: #3366ff;\"><strong>Safe Shelters: Section 12(3) of the Transgender Act 2019 states that whether any parent or a member of his immediate family is unable to take care of a transgender, the competent court shall by an order direct such person to be placed in the rehabilitation centre. In consonance with the same,\u00a0the SMILE scheme provides for setting up of Garima Grehs, to provide shelter to the transgender persons in need\u00a0with basic amenities like food, medical care, and recreational facilities.<\/strong><\/span><\/li>\n<li><span style=\"color: #3366ff;\"><strong>21 Garima Grehs, shelter homes for destitute transgender persons in 17 States\u00a0namely Andhra Pradesh, Assam, Bihar, Chhattisgarh, Delhi, Gujarat, Jharkhand, Karnataka, Madhya Pradesh (2), Maharashtra (3), Manipur, Odisha, Punjab, Rajasthan, Tamil Nadu, Uttar Pradesh and West Bengal (2) have been set up. The Portal is accessible in multiple languages (English, Hindi, Gujarati, Malayalam and Bengali).This is an end-to-end online process where the applicant can apply for the TG certificate and also download the certificate after issue without any requirement to go to any office of issue.<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #3366ff;\"><strong>Conclusion<\/strong><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #3366ff;\"><strong>Recent years have witnessed significant legal and policy reforms for the transgender community in India, spearheaded by the Government of India and its concerned ministries.
